The first step to President Obama’s business-related executive action has been taken!!! Today, US Citizenship and Immigration Services Director Leon Rodriguez announced that the Department of Homeland Security will grant work authorization for certain H-4 dependent spouses. Work authorization will be limited to the dependent spouses of H-1B visa holders with an approved I-140, Immigrant Petition for Alien Worker. These individuals and their dependent spouses are in the final stage of the green card process. The underlying policy is that the H-1B holder and H-4 dependent spouses already have been approved for a green card and are merely waiting for a visa number to become available. Therefore, there should be no impediment to gainful employment. Due to significant backlogs in green card number availability, especially for countries like India and China, the wait can be as long as 10 years. Such a lapse in work experience could be devastating to the H-4 spouse’s career, not to mention the strain it could have on the family’s financial situation. The directive will take effect on May 26, 2015.
